California Law Blocks In-N-Out’s Worker Mask Ban

The well-known burger chain In-N-Out has prohibited employees from wearing masks while on the job. However, In-N-Out employees in California still have the freedom to choose whether to conceal their faces until at least February 2025 because of the state’s unique COVID-19 workplace regulations.

As reported by KTVU, the business claimed in a memo that it decided to remove the mask requirement in order to put customer service first and to let its employees show off their smiles and other facial traits.

It’s interesting to note that In-N-Out uses a different strategy based on the state where their locations are located. The states where In-N-Out has 116 stores, including Arizona, Colorado, Nevada, Texas, and Utah, have banned masks. 

However, it will be up to each worker’s discretion whether to wear a mask in California and Oregon.

The strategy taken by this state is very important because 70% of all In-N-Out restaurants are located in California.

In-N-Out has already dealt with controversy over its working policies related to the COVID-19 outbreak.

California’s COVID-19 Rules Modified in 2023

The business declined to enforce the state of California’s municipal indoor vaccine requirements in the fall of 2021. 

Some shops in San Francisco and the East Bay were temporarily closed when they refused to check consumers’ vaccination records.

The COVID-19 criteria were modified in 2023 by California’s Division of Occupational Safety and Health, which is in charge of workplace safety laws. 

One of these revised regulations is that businesses must permit employees to wear face coverings if they choose to do so, unless doing so poses a risk to their safety.

Because the company’s restriction does not overrule the state’s workplace safety regulations, In-N-Out employees in California can still choose whether to wear masks while working. 

The predicament serves as a reminder of the continuous complexity and difficulties firms must overcome while negotiating COVID-19 laws in various states.
